Terms & Conditions – Novated Lease Australia Pty Ltd
1. Introduction
This online platform (Platform) is operated by Novated Lease Australia Pty Ltd (ABN 69 659 639 004) and its successors and assignees (Novated Lease Australia, NLA, we, us or our). The Platform is available at www.novatedleaseaustralia.com.au and may also be accessible via additional channels or domains.
These terms and conditions (Terms) form a legally binding agreement between NLA and the business entity accessing and using our Platform (you). Our Platform assists business users to obtain finance from third-party lenders (Lenders) and, where offered, directly from NLA (Services).
By accessing or using our Platform and/or submitting an application, you:
- confirm that you have read, understood and agree to these Terms;
- warrant that you have the authority and legal capacity to bind the business you represent; and
- agree to use the Platform in accordance with these Terms.
If you do not agree to these Terms, you must cease using the Platform immediately.
Our Privacy Policy and Terms of Use form part of these Terms. We may update these Terms at any time by publishing updated terms on our Platform. Continued use of the Platform constitutes acceptance of the updated Terms. If Terms change while your application is pending, the Terms active at the time you submitted your application will apply.
2. Our Services
2.1 We only process applications submitted in accordance with these Terms.
2.2 There is no cost to submit an application or to assess eligibility for finance. Should you proceed with finance, you will enter into a separate loan agreement with either the Lender or NLA. Where there is any inconsistency between these Terms and the loan agreement, the loan agreement prevails.
2.3 When we refer you to a Lender, we act solely as an introductory platform. Lenders are independent and not employees, agents or representatives of NLA. We are not a party to any loan agreement between you and a Lender.
2.4 You may withdraw your application at any time prior to signing a loan agreement by notifying the Lender or NLA.
2.5 Recommendations are based on information you provide. You warrant all information submitted is accurate, complete and current, and you agree to update us if details change prior to entering a loan agreement.
3. Prohibited Conduct
You must not use our Platform for any unlawful, misleading, malicious or inappropriate purpose, including but not limited to:
- impersonation or misrepresentation;
- submitting false, misleading, or incomplete information to obtain finance;
- infringing the privacy rights of others;
- uploading harmful technology (e.g. viruses, malware);
- harassment or offensive conduct;
- interfering with the Platform or other users;
- breaching any applicable law or regulation; or
- using the Platform to compete with our business.
We may reject current or future applications if we suspect or determine non-compliance with this clause.
4. Collection of Personal Information
We collect personal information to provide our Services and operate the Platform. We may disclose information to third-party providers, including Lenders, brokers, IT providers, credit reporting agencies (including Equifax), and verification services (including the Document Verification Service (DVS)), or where required by law.
By submitting an application, you consent to:
- identity verification through the DVS;
- credit enquiries being made with permitted credit bodies; and
- disclosure of information in accordance with our Privacy Policy.
Failure to provide requested information may limit our ability to provide the Services.
This clause survives termination of these Terms.
5. Intellectual Property
We own or license all intellectual property rights in the Platform and its content. We grant you a non-exclusive, revocable, non-transferable licence to use the Platform for lawful business purposes in accordance with these Terms. You may not reproduce, alter, distribute or exploit Platform content without written consent.
6. User Content
By uploading content to the Platform, you grant NLA a perpetual, royalty-free licence to use that content for Platform and business purposes. You warrant you have the right to upload such content and that it does not infringe any third-party rights. We may remove content at our discretion.
7. Warranties and Disclaimers
The Platform and content are provided for general information only. We do not guarantee:
- accuracy, completeness or suitability of information;
- continuous secure access; or
- that recommended finance products are optimal for your circumstances.
We are not responsible for the conduct of Lenders. You should obtain independent financial advice.
8. Limitation of Liability & Indemnity
To the maximum extent permitted by law:
- we are not liable for loss, liability or damages arising from your use of the Platform or dealings with Lenders; and
- you indemnify NLA against losses arising from your breach of these Terms or misuse of the Platform.
This clause survives termination.
9. Termination
We may suspend or terminate access where Terms or laws are breached, or complaints are received from Lenders. You may cease Platform use at any time.
10. Disputes
Parties must attempt to resolve disputes through good faith discussion within 21 days before commencing litigation.
11. General
Includes waiver, relationship of parties, severability, assignment (requires our consent), entire agreement clause and governing law (Victoria, Australia). Users overseas access the Platform at their own risk.
