Welcome and thank You for choosing Motor Vehicle Lease Insurance.

This Product Disclosure Statement (PDS) is an important document that contains the standard policy terms, conditions, limits and exclusions of this Motor Vehicle Lease Insurance and other important information. It is designed to help You make an informed decision about whether to purchase this insurance and compare it with other products You may be considering.

You need to ensure You have all the protection You need, so please read through this PDS carefully before making a decision to purchase this insurance, and store it in a safe place for easy reference.

1.2 Motor Vehicle Lease Insurance – A Snapshot

This is a high-level summary only and not a full description of the cover. For information on what is and isn’t covered, and for any limits, conditions, exclusions and excesses that apply, please carefully read this PDS, your Schedule and any other documents that make up your Policy.

Who we cover

  • Those named as insured(s) in your Schedule (“you”).

Type of cover we offer

Comprehensive insurance:

  • Accidental loss of (including theft) or Accidental Damage to your vehicle during the Period of Insurance, as listed under the Comprehensive Insurance section including “Other Benefits We Will Pay”. See Section 2.

  • Liability cover as specified in the Legal Liability section, including “Other Benefits We Will Pay”. See Section 3.

What cover you get for your vehicle
We will cover your vehicle for its Market Value, including:

  • Standard tools, modifications and accessories as supplied by the manufacturer;

  • Fitted or non-standard extras, modifications and accessories;

  • The value of wall charger, charging cable and charging accessories including wall mount for your vehicle if it is an EV.

What we pay for (where applicable)
If we agree to pay a claim for covered loss of or damage to your vehicle, we will:

  • At our option, repair or pay you the reasonable cost of repairs, or the Market Value of your vehicle in the event of a total loss; and

  • Pay for other covered benefits that apply, subject to the relevant limits.

What you pay for
If you make a claim and are responsible or at fault for the accident, you will be required to pay:

  • Any applicable excess amounts.

1.3 Understanding the Policy

This PDS is an important document. Please read it carefully before making a decision.

It will help you to:

  • Decide whether this insurance will meet your needs; and

  • Compare it with other products you may be considering.

Any recommendation or opinion in this document is of a general nature only and does not take into account your objectives, financial situation or needs.

You need to decide if this insurance is right for you, and should read all the documents that make up the Policy to ensure you have the cover you need.

1.4 Your Insurance Contract with Us

When we agree to enter into a Policy with you, it is a contract of insurance between us and you.

The Policy consists of:

  • This PDS which sets out the standard terms of your cover and its limitations;

  • Any applicable Supplementary PDS (SPDS) we issue that varies it;

  • Your current Schedule, which shows the insurance details relevant to you. It may include additional terms, conditions and exclusions relevant only to you that amend the standard terms of this document. Only those sections shown as covered in your Schedule are insured;

  • Any other document we tell you forms part of the Policy, as advised by us in writing at or before commencement of the Policy or when required or permitted by law, which may vary or modify the above documents.

These are all important documents and should be carefully read together and kept in a safe place for future reference.

Any new or replacement Schedule we send you, detailing changes to your cover or Period of Insurance, will become the current Schedule and should be carefully read and retained.

Cover is provided on the basis:

  • That you have paid or agreed to pay us the premium for the cover provided; and

  • Based on the verbal and/or written information you provided after being advised of your Duty to take reasonable care not to make a misrepresentation either verbally or in writing.

1.5 Customer Care – Customers Experiencing Vulnerability

We recognise that you may find yourself in difficult circumstances, particularly when a claim event occurs. We have developed a Customer Care process to provide additional support to you if you are experiencing vulnerability due to your circumstances, including personal circumstances not directly related to insurance.

The Code provides the following examples that may contribute to someone needing customer care:

  • Age

  • Disability

  • Mental health conditions

  • Family violence

  • Language barriers

  • Literacy barriers

  • Cultural background

  • Aboriginal or Torres Strait Islander status

  • Remote location

  • Financial distress

1.6 The Value We Apply to Your Vehicle

We insure your vehicle for Market Value. The value that applies to your vehicle will be shown on your Schedule.

Market Value
Market Value is the cost to replace your vehicle with a vehicle of the same make, model, age and condition as your vehicle immediately prior to the loss or damage, but excluding costs and charges for:

  • Registration

  • Compulsory Third Party (CTP) insurance

  • Stamp duty transfer

  • Dealer warranty costs

  • Transfer fees or dealer delivery

To determine the Market Value, we consider:

  • Local market prices

  • Your vehicle’s condition

  • Any modifications, options or accessories added to your vehicle

  • Wall charger, charging cable and charging accessories including wall mount used for your vehicle if it is an EV

1.7 Your Premium

In return for paying or agreeing to pay your premium, we will provide the cover you have chosen.

When calculating your premium, we consider a range of factors that have been shown to determine the likelihood of a claim. These include:

  • The type of vehicle you have

  • Its value

  • Where it is kept

  • Relevant claims and incident/accident history

Minimum premiums may apply. In some cases, discounts or entitlements may apply if you meet our criteria. Any applicable discounts or entitlements will:

  • Only apply to the extent the minimum premium is not reached

  • Be applied in a predetermined order

  • Be subject to rounding and apply only to the base premium (before taxes and government charges)

Your premium also includes amounts we are required to pay for compulsory government charges, such as:

  • Stamp Duty

  • GST

  • Emergency and Fire Services Levies

These will be listed separately on your Schedule as part of the total premium payable.

We may estimate and allocate levies based on Government requirements. We won’t adjust your premium due to under/over-recovery. You can contact us for details.

If you fail to pay your premium, we may reduce any claim payment by the unpaid amount and/or cancel your Policy as outlined in the “Cancellation Rights Under Your Policy” section.

1.8 Your Cooling-Off Rights

A 14-day cooling-off period applies to this insurance. You can cancel it within 14 days from:

  • The date we issue a new Policy to you; or

  • The start date of a renewed Policy

We’ll refund your premium in full, provided:

  • You haven’t made a claim; and

  • You don’t intend to make a claim

We may deduct government taxes or duties from your refund. See “Cancellation Rights Under Your Policy” for further detail.

1.9 When the Policy Ends

Your Policy will end at the earliest of:

  • The expiry date shown on your Schedule

  • Cancellation of your Policy

  • When we agree to settle your claim as a total loss for the relevant vehicle

1.10 Renewal Procedure

Before your Policy expires, we will advise whether we intend to offer renewal and, if so, on what terms.

This PDS will apply to any renewal unless we tell you otherwise.

It’s important to check the renewal terms, including sum insured amounts and excesses, to ensure the cover remains appropriate.

1.11 Your Duty to Take Reasonable Care Not to Make a Misrepresentation

You must take reasonable care not to make a misrepresentation to us. This obligation applies:

  • Until we first issue your Policy

  • Each time we agree to renew, extend, vary or reinstate your Policy

You must answer our questions honestly and to the best of your knowledge. A misrepresentation includes a false or misleading statement, including one that is incomplete.

This duty applies to everyone insured under the Policy. If you answer questions for others, we treat your responses as theirs.

Whether you’ve taken reasonable care will be assessed based on all relevant circumstances.

If you do not comply with this duty:

  • We may reject or reduce your claim

  • We may cancel your Policy

  • If the misrepresentation was deliberate or reckless, we may treat your Policy as never having existed

1.12 Governing Law

This Policy is governed by the laws of the Australian State or Territory where the Policy is issued.

1.13 Some Words Have Special Meanings

Certain words in this Policy have special meanings. See Section 1.14 "Words With Special Meanings".

These meanings apply wherever the words are capitalised. Some sections or documents may assign additional special meanings.

Headings are for reference only and do not affect interpretation.

1.14 Words With Special Meanings

This section defines key terms used throughout this PDS and associated documents. Examples include:

  • Accident or Accidental: A sudden, violent, external, unusual and identifiable specific event which happens unexpectedly and is unintended.

  • Accidental Damage: Damage resulting from an Accident.

  • Advanced Driver Assistance Systems (ADAS): Systems that assist with vehicle control (e.g. emergency braking, cruise control).

  • Electric Vehicle (EV): Vehicles powered by electricity, including plug-in hybrids, approved by us for coverage.

  • Excess: The amount you must contribute towards a claim (see Section 7).

2. Benefits of Cover Available

2.1 Comprehensive Insurance

This section outlines the comprehensive insurance benefits provided under this Policy.

To ensure you’re covered, always contact us for approval before incurring expenses. If you don’t, we will only pay up to the amount we would have authorised.

2.2 Accidental Loss of or Damage to Your Vehicle

We cover you for accidental loss (including theft) or Accidental Damage to your vehicle during the Period of Insurance, subject to the Policy’s terms, conditions, limits and exclusions.

If Section 2.3 (New for Old) does not apply, we will:

  • Repair your vehicle; or

  • Pay the reasonable cost of repair; or

  • Pay the Market Value

For EVs, we also cover fire caused by Thermal Runaway, provided manufacturer battery use and charging specs were followed.

2.3 New for Old Replacement of a New Vehicle After a Total Loss

We will replace your vehicle with a new one of the same make, model, engine size, features and paint type (if available in Australia), provided:

  • It’s a total loss

  • You purchased it new or as a demonstrator

  • It’s under 3.5 tonnes Gross Vehicle Mass

  • Your financier consents (if financed)

  • The vehicle is less than 2 years old from first registration

We’ll also pay stamp duty, dealer charges, and up to 12 months of registration.

If no replacement is available, we will pay the Market Value.

2.4 Other Benefits We Will Pay

We pay these benefits in addition to the amount for loss or damage to your vehicle, unless stated otherwise.

Each benefit has its own limits. Examples include:

Accommodation and Travelling Expenses

Up to $5,000 if your vehicle is over 100km from home and:

  • Damaged and not driveable; or

  • Stolen and not recovered within 14 days

Additional Accessories

  • Up to $5,000 for loss/damage to equipment and apparatus, including navigation equipment and portable chargers (excludes mobile phones)

Automatic Additions and Deletions

  • Cover for new/replacement vehicles of similar type (up to $250,000 each) if notified within 30 days

Automatic Trailer Cover

  • Up to $5,000 for loss or damage to a trailer under 2 tonnes while attached

Child Seat or Capsule Replacement

  • Up to $1,000 per incident

Emergency Repairs

  • Up to $2,500 to make your vehicle driveable after a covered accident, malicious damage or theft recovery.

Fire Brigade and Emergency Services Cover

  • Up to $25,000 for charges imposed by fire brigade, police, ambulance, environmental protection or other emergency services following a covered accident.

Hire Vehicle Following an Accident

  • Up to $100 per day, to a maximum of $4,200 for a rental vehicle when your vehicle is being repaired or assessed for damage.

Hire Vehicle Following Fire and Theft

  • Up to $100 per day, to a maximum of $4,200, when your vehicle is damaged by fire or theft (sedan, SUV, 4WD, electric vehicle or utility).

We must arrange the hire car. If you arrange one without our approval, we are not obliged to pay for it.

Hired Vehicles

  • Up to $5,000 per event for excess payable on an insured hired vehicle (under 3.5 tonnes Gross Vehicle Mass).

Personal Property

  • Up to $2,500 for belongings damaged in a collision, stolen from your locked vehicle, or stolen with your vehicle. Includes family or employee items. Excludes firearms, mobile phones, and monetary items.

Re-keying and Re-coding

  • Up to $5,000 per event to replace stolen keys and re-code locks.

  • Only applies if reported to police and keys were not taken by someone residing with you.

Removal of Basic Excess for Windscreen Claims

  • One windscreen/window glass claim per Period of Insurance will not incur the basic excess.

  • Applies only if the glass is the sole damage and the vehicle is a sedan, SUV, 4WD, electric vehicle or under 3.5 tonnes.

Removal of Debris

  • Up to $50,000 for cleanup and removal of vehicle debris after a covered accident.

Sign Writing

  • Up to $25,000 per event for reinstating damaged signwriting/artwork.

Towing

  • Covers reasonable costs for protection, removal, and towing of your vehicle following a covered accident or theft.

Vehicle Return

  • Up to $5,000 per event to return your vehicle to its original destination or point of departure after a covered accident, if not driveable.


3. Legal Liability

Always seek our approval before incurring expenses. If you do not, we will pay only what we would have authorised.

3.1 Cover for Damage to Other People’s Property (Legal Liability)

We cover your legal liability to pay compensation for damage to someone else’s property arising from a covered accident during the Period of Insurance, where you are partly or fully at fault.

This cover applies to:

  • Your use of your vehicle or a substitute vehicle being serviced/repaired.

  • A trailer towed by your vehicle.

It also extends to:

  • Anyone driving your vehicle or a substitute vehicle (not a rental or hire vehicle) with your permission.

  • Passengers in or entering/exiting your vehicle (with your permission).

  • Your employer, principal or partner using your vehicle or substitute vehicle.

We do not cover liability for:

  • Unregistered vehicles.

  • Claims insurable under compulsory schemes (e.g. TAC).

  • Vehicles used on rails.

  • Loss or damage to aircraft.

  • Loss or damage to property you, your spouse or de facto own, except:

  • Residential buildings you are renting or using;

  • Employee or visitor vehicles in your provided car park.

3.2 Other Benefits We Will Pay

Legal Costs

  • We pay reasonable legal defence costs related to a covered liability claim, if we approve them in writing.

We do not cover legal costs for criminal or traffic offences.

Supplementary Bodily Injury Cover
We cover legal liability for death or bodily injury caused by:

  • Driving or being in charge of your vehicle or substitute vehicle.

  • Goods being carried by or falling from the vehicle.

  • Loading/unloading the vehicle.

Exclusions include:
We do not pay if:

  • Cover is available under a statutory scheme (even if recoverable amount is nil).

  • You failed to insure/register the vehicle or meet legal scheme requirements.

  • The injured person was driving or in charge of the vehicle.

  • The injured person was your family member or employee.

  • The injury was solely psychological or psychiatric without related physical injury.

  • You or the insured person failed to notify us in time and it prejudiced our ability to respond.

  • The injury or damage was caused intentionally.

  • The court awards exemplary, aggravated or punitive damages.

Cross Liability
Each insured party is treated as if separately insured. We waive subrogation between named insureds.

Joint Insured
A claim made by one person named in the Schedule is treated as made by all named persons.

4. When We Will Not Pay Your Claim

You are not covered and we will not pay any claim for:

Loss of Use

  • Loss or damage suffered because you cannot use your vehicle.

Wear and Tear or Breakdown

  • Loss, damage or liability caused by wear and tear, rust, corrosion, depreciation, or mechanical, structural, electrical or computer failures.

Tyres

  • Damage to tyres or rims caused by braking, road punctures, cuts or bursts.

Old Damage

  • Pre-existing damage or faulty repairs (unless originally repaired under this Policy with our agreement).

Intentional Damage

  • Damage caused intentionally by you or someone acting with your consent.

Failure to Safeguard

  • Further damage following an incident where you did not take reasonable steps to protect your vehicle.

Underground Services and Vibration

  • Loss or liability due to:

  • Damage to underground pipes, cables, or services.

  • Vibration or removal/weakened support to land or property caused by your vehicle.

  • If overhead cables are contacted, we will pay up to $100,000 per event for direct physical damage only.

Trailers

  • Loss or liability caused by attaching more than the legal number of trailers.

Driving Under the Influence

  • Loss or liability when the driver is impaired by drugs or alcohol, or over the legal limit.

We may cover you (but not the driver) if it was reasonable for you not to know the driver was impaired.

EV Accessories Liability

  • Liability to third parties for injury/damage caused by EV charging accessories when not used by the insured vehicle.

Charging Equipment Hacking

  • No cover for losses resulting from charge points being hacked.

Computer Failure or Viruses

  • Damage due to malfunction of computerised equipment or software viruses.

  • Accidental damage resulting from such breakdown may still be covered.

Non-Owned Charging Equipment

  • No cover for damage to EV charging accessories not owned by the vehicle owner.

Refusing a Drug/Alcohol Test

  • No cover if the driver refuses a legally required test.

We may still cover you (not the driver) if you were unaware they refused.

Unlicensed Drivers

  • No cover if driven by an unlicensed person (with your consent), unless it was reasonable for you not to know.

Overloaded Vehicles

  • Damage or liability caused by towing or carrying more than the manufacturer’s limits.

Unroadworthy Condition

  • Damage caused by an unsafe or unroadworthy vehicle.

We may still cover you if the condition wasn’t reasonably detectable or did not contribute to the loss.

Testing (Non-Service Related)

  • Damage caused by testing unless done for service/repair by a qualified person.

Motor Sports

  • Damage or liability when used in races, trials, contests, or sports events.

Experiments

  • Use for experiments, demos or testing in the motor trade.

Hire or Reward

  • Use for passenger hire or reward unless stated in your Schedule.

Includes renting/hiring EV charging cables or wall boxes.

Vehicle Hire

  • Renting or hiring out your vehicle unless listed on your Schedule.

Stock in Trade

  • While your vehicle is held by another for sale.

Vehicle Seizure

  • After your legal interest ends or if lawfully seized.

Illegal Use

  • If your vehicle was used for an illegal purpose with your consent.

War

  • Loss caused by war, insurrection, or military power.

Nuclear

  • Loss caused by nuclear material or waste.

Geographical Limitation

  • Damage that occurs outside Australia or New Zealand.

Financial Loss

  • Reduced resale value, shortened working life, or inability to use your vehicle.

Underground Mining

  • Use for underground drilling/tunnelling or driving in underground mines.

Economic Sanctions

  • We won’t provide cover if it breaches trade sanctions by the UN, Australia, US, UK, NZ, or EU.

Asbestos

  • Any loss arising from asbestos or materials containing asbestos.

Silica

  • Claims relating to exposure to silica in any form.

Terrorism

  • Any loss or injury caused by terrorism, or by any action taken in response to it.

5. General Conditions Applicable to the Policy

Obligation to Comply

You must comply with all terms and conditions.

We may reduce or decline a claim if we are prejudiced by non-compliance.

Do Not Admit Liability

You must not:

  • Admit fault or liability.

  • Offer or agree to any settlement without our written consent.

This includes any offers related to legal liability claims.

Keeping Evidence

You should retain evidence of the value of your property and any loss or damage.

Prevention of Loss

You must take all reasonable steps to avoid injury, loss or damage.

  • Secure your vehicle when unattended.

  • Remove keys and lock the vehicle.

  • Keep your vehicle in good repair.

We may refuse claims where damage is caused by poor maintenance.

Advanced Driver Assistance Systems (ADAS)

If your vehicle has ADAS features:

  • Follow manufacturer instructions.

  • Install software and safety updates.

  • Use the system as permitted by law.

If we repair your vehicle, we will also recalibrate ADAS if required. If we don’t repair it, you must arrange recalibration.

Failure to follow these requirements may reduce your claim.

6. Making a Claim

Assisting with Your Claim

You must assist us by:

  • Providing requested information and documents.

  • Taking reasonable steps to help recover any amounts we may be entitled to.

We may not pay your claim if you don’t cooperate.

When You Are at Fault

You are considered at fault if:

  • You caused the accident.

  • You contributed to the accident.

What We Pay
If we settle a claim, we may:

  • Repair your vehicle.

  • Pay the cost to repair your vehicle.

  • Pay the Market Value.

  • Pay other applicable benefits.

  • Deduct your excess or unpaid premium.

How We Settle Your Vehicle Claim

Repairing Your Vehicle
We may arrange repairs with our chosen repairers, or approve your own.

Paying the Repair Cost
We may pay the reasonable repair cost directly to you.

Total Loss
We may declare a total loss if:

  • The vehicle is uneconomical to repair; or

  • It has been stolen and not recovered.

If so:

  • Cover for that vehicle ends.

  • We pay the Market Value less your excess and any unpaid premium.

  • We keep the vehicle unless you buy it back at the salvage value.

Other Benefits
We pay for covered extras up to their limits.

6.1 Choosing a Repairer

If we authorise repairs to your vehicle, you can:

  • Choose from our selected repairers; or

  • Nominate your own repairer (we must authorise repairs before they begin)

If your repairer’s quote is higher than we consider reasonable:

  • We may ask you to provide another quote; or

  • Offer to move the vehicle to a repairer we choose (at our cost)

We guarantee the quality of repairs for as long as you own the vehicle, provided:

  • We authorised the repairs; and

  • The repairs are not subject to a defect warranty or recall by the manufacturer or repairer.

6.2 Parts Used to Repair Your Vehicle

If we repair your vehicle, we will:

  • Use new parts or manufacturer-approved parts if available.

  • Use used parts only when:

  • The part is no longer manufactured;

  • You agree to it; or

  • It is a body panel where reuse is safe and appropriate.

For EVs, we may source parts and software updates from the original manufacturer.

You are responsible for any modifications or upgrades not approved or supplied by the manufacturer, unless covered under the Policy.

7. Our Excesses

An excess is the amount you must pay when making a claim. We will apply the following excesses where applicable:

Basic Excess

  • Applies to all claims unless otherwise stated.

Age Excess

  • Additional excess for drivers under 25 (unless stated otherwise).

Inexperienced Driver Excess

  • Applies to drivers with less than two years’ driving experience in Australia.

Undeclared Driver Excess

  • Applies if a driver involved in the accident wasn’t declared on your Schedule.

Voluntary Excess

  • If selected, this amount is added to your total excess and shown on your Schedule.

Special Excess

  • Any additional excess noted on your Schedule or in writing by us.

If more than one excess applies, they are added together and deducted from the claim amount.

8. Changes to Your Policy

Please contact us if your circumstances change during the Period of Insurance, including if:

  • You change your address.

  • You change how your vehicle is used.

  • You change or modify your vehicle.

  • There is a change in the regular drivers of your vehicle.

These changes may impact your:

  • Premium

  • Cover

  • Excess

  • Ability to claim

We will confirm any changes in writing and update your Schedule.

8.1 Cancellation Rights Under Your Policy

Cancellation by You
You may cancel your Policy at any time by notifying us in writing.

If you cancel:

  • We will refund the unused premium (less government charges).

  • If you pay by instalments, we may deduct any outstanding amount.

Cancellation by Us
We may cancel your Policy as allowed by law, including if:

  • You fail to pay the premium;

  • You didn’t comply with your duty of disclosure; or

  • You breach a Policy condition.

We will notify you in writing and provide reasons.

9. Privacy Notice

We collect your personal information to:

  • Provide and manage your insurance;

  • Handle claims;

  • Conduct marketing; and

  • Comply with legal obligations.

We may disclose your personal information to:

  • Our related companies;

  • Service providers;

  • Government agencies;

  • Other insurance companies;

  • Anyone you have authorised; and

  • Others where required by law.

Some of these recipients may be located outside Australia, including in India, the Philippines and other countries.

11. If This Insurance Has Been Issued Through an Insurance Intermediary

If an insurance intermediary has arranged this Policy:

  • They act on your behalf, not on behalf of Allianz.

  • You should direct any questions or instructions to the intermediary.
